California's New Stormwater TMDL Rules & It's National Effects

At the end of last year, California adopted the first-in-the-nation stormwater permit regulation incorporating TMDLs and NELs. There are several major changes in store for the approximately 10,000 industrial facilities that discharge stormwater into California waterways. Most notably, for the first time, exceeding a numeric effluent limitation (NEL) will be an automatic violation of the permit, subject to enforcement and plaintiff’s citizen suits.
